“Win a Culinary Sojourn to Boulder Colorado” Sweepstakes
OFFICIAL RULES
NO PURCHASE REQUIRED TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1. SPONSOR: Big Red F Management Company, LLC, 1928 Pearl Street, Boulder, Colorado (“Sponsor”)
2. ELIGIBILITY: The “Win a Culinary Sojourn to Boulder Colorado” sweepstakes (the “Promotion”) is open only to legal U.S. Residents who are at least twenty-one (21) years old at time of entry. Employees of Big Red F Management Company and its affiliated companies, vendors, agents, as well as the immediate family (parents, children, siblings, spouses and grandparents) and household members of each are not eligible. Sweepstakes is subject to all federal, state and local laws and regulations. Void where prohibited. Odds of winning the prize offered will depend upon the total number of eligible entries received.
3. TIMING: The Promotion Entry Period begins at 12:01 a.m. Mountain Time (“MT”) on December 24, 2011 and ends at 11:59 p.m. MT on February 29, 2012. Sponsor’s computer system is the official timekeeping device for the Sweepstakes.
4. THE PRIZE: There is one (1) Grand Prize being offered, consisting of a 4-day / 3-night trip for the winner and a traveling companion to Boulder, Colorado in July 2012. Trip includes coach airfare from a major airport, within the continental United Sates, near the winner’s home, to Denver, Colorado if booked by the Sponsor, hotel accommodations (double occupancy), meals and activities included in the Promotion itinerary, as well as local transportation while in Colorado (including transportation between Denver International Airport and Boulder). Approximate retail value of this prize is $4, 000.
5. TO ENTER: Visit www.bigredf.com and complete all the survey questions. Entries must include the applicant’s name, age, email address, answers to any other questions posed, and an affirmation that entrant can travel to Boulder, Colorado in July 2012. All information provided by entrant must be complete, true and correct. Submissions to the Promotion must be received by the end of the Promotion Entry Period in order to be eligible; entries received after the deadline will be deemed ineligible to win. All submitted entries become the property Sponsor and receipt will not be acknowledged. Sponsor is not responsible for lost, late, inaccurate, incomplete, or misdirected entries. Entry is limited to one entry per person/email address. Multiple entries from the same person/email address will result in disqualification of all submitted entries. Use of any automated entry software is prohibited.
6. WINNER SELECTION: On or about March 15, 2012, ten (10) finalists will be selected from all eligible responses, based primarily on the entrant’s greatest food memory paragraph. Finalists and details from their Promotion entries will be listed on the Big Red F Facebook page, and Facebook friends of the BigRedF, will be asked to vote for their favorite candidate. The finalist with the most Facebook votes will be deemed the Grand Prize winner. The winner will be notified by email or phone on or before April 30, 2012. Winner and traveling companion will be required to sign and return a sworn Affidavit of Eligibility, and Liability and Publicity Release. (The traveling companion must also meet the Eligibility requirements included herein.) If required documentation is not returned within seven (7) business days of notification, or if notification is returned as undeliverable, prize will be forfeited and an alternate winner will be selected. Only two (2) alternate winners will be selected, after which the prize will remain un-awarded.
7. PRIZE CONDITIONS: No prize substitution or transfer is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value (including cash, at Sponsor’s sole discretion) for any reason. Sponsor is required by law to report prize values to taxing authorities; all taxes and any other incidental expenses on prizes are the sole responsibility of each winner. The Grand Prize is a unique travel experience, requiring specialized itinerary planning and coordination with numerous companies and individuals for the specific 4-Day prize period in July 2012. While Sponsor will make reasonable efforts to accommodate the personal schedule of the Grand Prize winner and traveling companion (the “winners”), if the winners are unable to be present for the whole travel itinerary, they will be deemed ineligible and alternate winners will be chosen.
8. PUBLICITY: Except where prohibited, participation in the Promotion constitutes Entrant’s consent to Sponsor’s use of Entrant’s name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
9. AGREEMENT TO OFFICIAL RULES: By participating in the Promotion, each Entrant fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries, the selection of the winner, and the awarding of any prize), which are final and binding in all respects.
10. LIMITATIONS OF LIABILITY: By participating in the Promotion, you agree to release Sponsor and its affiliated companies, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the entry, receipt, ownership, possession, use, or misuse of any prize. Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Promotion, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the prizes, in any Promotion-related materials, or that may limit prize fulfillment or a participan’s ability to enter the Promotion.
11. GENERAL CONDITIONS: Sponsor reserves the right to amend these Official Rules. Sponsor reserves the right, in its sole discretion, to terminate, modify or suspend the Promotion if, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion. In such event, Sponsor reserves the right (but does not have the obligation) in its sole discretion to award the Grand Prize at random from among eligible, non-suspect entries received up to the time of suspected impairment. Sponsor may permanently disqualify from the Promotion any person it believes has tampered with the entry process or intentionally violated these official rules. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Promotion is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision.
12. PRIVACY: Sponsor collects personal information from entrants when they enter the Sweepstakes. Information collected by Sponsor online is subject to Sponsor’s Privacy Policy.
13. DISPUTE RESOLUTION: Except where prohibited by law, by entering you agree that: (i) all issues and questions concerning the interpretation, validity, and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of Colorado, without regard to its rules on conflicts of law; (ii) any action at law or in equity arising out of or relating to this Sweepstakes, or awarding of any prize, shall be filed only in the state or federal courts located in the State of Colorado, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action; (iii) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; (iv) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorney’s fees; and (iv) you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
